Predatory Lending Laws
The forums below are designed to guide you to the various consumer protection laws that can be used to fight predatory lending and mortgage fraud effectively. An informed consumer is a powerful consumer.
The federal Truth In Lending Act (TILA), was originally enacted by Congress in 1968 as a part of the Consumer Protection Act. The law is designed to protect consumers in credit transactions by requiring clear disclosure of key terms of the lending arrangement and all costs. TILA is one of the most powerful laws that can be used to fight lenders that have preyed on you or your client.

RESPA requires that consumers receive disclosures at various times in the transaction and outlaws kickbacks that increase the cost of settlement services. RESPA is a HUD consumer protection statute designed to help homebuyers be better shoppers in the home buying process, and is enforced by HUD. RESPA covers loans secured with a mortgage placed on a one-to-four family residential property. These include most purchase loans, assumptions, refinances, property improvement loans, and equity lines of credit. This is another powerful law that can be used effectively to fight lending and servicing abuses.

Let's face reality. The mortgage brokers over the last 5 years operated like it was the wild, wild west. For many, money came first and the law last. A lot of consumers have been scammed, duped, swindled and sold a toxic loan when they should have obtained a plain vanilla mortgage.
